These Terms of Service (“Terms”) govern your use of the website and services provided by M and M Group (“we”, “us”, “our”). By accessing our website or engaging our services, you agree to be bound by these Terms. Please read them carefully.
1. About us
M and M Group is a South African multi-division business solutions company based in uMlazi, KwaZulu-Natal. We provide services across six divisions: Human Resources, Financial Solutions, Sales & Marketing, Public Relations, IT Solutions and Business Documentation — with project management embedded across every engagement.
2. Our services
We provide services across six integrated divisions — Human Resources (including recruitment, payroll and CCMA representation), Financial Solutions (accounting, bookkeeping, tax and CIPC services), Sales & Marketing, Public Relations, IT Solutions (email, domains, internet, cloud and VoIP) and Business Documentation. Specific deliverables, timelines and fees are agreed in writing in a proposal or service agreement before work commences.
3. Client responsibilities
You agree to:
- Provide accurate and complete information necessary for us to deliver our services;
- Grant us reasonable access to systems, data and personnel required to perform the work;
- Ensure you have the right and authority to provide us with any third-party data or systems;
- Notify us promptly of any changes that may affect the delivery of services.
4. Quotes, fees and payment
All fees are set out in our proposal or service agreement. Unless otherwise agreed, invoices are payable within 30 days of the invoice date. We reserve the right to suspend services where payment is overdue. Fees exclude VAT and any applicable taxes unless stated otherwise.
5. Intellectual property
All intellectual property, including software, designs, content and materials created by us in the course of a project, becomes the property of the client upon full payment, unless otherwise agreed in writing. Our pre-existing tools, methodologies and intellectual property remain our property.
6. Confidentiality
Both parties agree to keep confidential any non-public information obtained in the course of the engagement and to use it only for the purpose of performing the services. This obligation survives the termination of the engagement.
7. Warranties and liability
We warrant that our services will be performed with reasonable skill and care. To the maximum extent permitted by law, our total liability arising out of or in connection with our services is limited to the fees paid by you for the services giving rise to the claim. We are not liable for indirect, incidental or consequential damages, loss of profits, or loss of data.
8. Termination
Either party may terminate an engagement by giving written notice as specified in the service agreement. Upon termination, you are responsible for payment of all work completed up to the termination date. Any provisions that by their nature should survive termination will survive.
9. Governing law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes will be subject to the exclusive jurisdiction of the courts of South Africa.
10. Changes to these Terms
We may update these Terms from time to time. Updated Terms will be posted on this page with a revised effective date. Continued use of our website or services after changes are posted constitutes acceptance of the updated Terms.
